§1 Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers via the website https://big-little-insects.com with

Paul Kämpf
(hereinafter referred to as “Provider”).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

§2 Contract Partner, Conclusion of Contract

The presentation of products on the website does not constitute a legally binding offer, but a non-binding display.

By completing the order process, the customer submits a binding offer to purchase. The contract is concluded once the Provider confirms the order by email.

§3 Products

The products offered are photographic works (e.g., fine art prints, photo prints, or comparable products).

Deviations in color, contrast, or brightness between screen display and print are technically unavoidable and do not constitute a defect.

§4 Prices and Shipping Costs

All prices are final prices.
No VAT is charged pursuant to §19 German VAT Act (small business regulation).
Shipping costs are shown separately during the order process.

§5 Delivery

Delivery is made to the address provided by the customer.
Delivery times depend on the product.
Individually manufactured products (e.g., custom sizes) may require longer production times.

For deliveries to countries outside the European Union, additional customs duties, taxes, or fees may apply. These are not included in the item price or shipping costs and must be borne by the customer upon import in the destination country. Information can be obtained from the relevant customs authority of the recipient country.

§6 Payment

The following payment methods are available (depending on the offer):

The purchase price is due immediately upon conclusion of the contract.

§7 Retention of Title

The goods remain the property of the Provider until full payment has been made.

§8 Copyright

All photographs offered are protected by copyright.

The purchase of a print does not transfer any usage rights to the image. The acquisition entitles the buyer solely to private possession.

Any reproduction, publication, digital use, or commercial use without the Provider’s prior written consent is prohibited.

§9 Warranty

Statutory warranty rights apply.

A defect does not exist in the case of:

minor color deviations
material-specific characteristics of paper or printing processes

§10 Liability

The Provider shall be fully liable in cases of intent and gross negligence as well as in the event of injury to life, body, or health.

In cases of simple negligence, the Provider shall only be liable for the breach of essential contractual obligations and limited to the foreseeable, typical damage.

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

§1 Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen, die Verbraucher über die Website https://big-little-insects.com bei

(im Folgenden „Anbieter“)

tätigen.

Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch selbständigen beruflichen Tätigkeit zugerechnet werden können.

§2 Vertragspartner, Vertragsschluss

Die Darstellung der Produkte auf der Website stellt kein rechtlich bindendes Angebot, sondern eine unverbindliche Präsentation dar.

Mit Abschluss des Bestellvorgangs gibt der Kunde ein verbindliches Angebot zum Kauf ab. Der Vertrag kommt zustande, sobald der Anbieter die Bestellung per E-Mail bestätigt.

§3 Produkte

Angeboten werden fotografische Werke (z. B. Fine-Art-Prints, Fotodrucke oder vergleichbare Produkte).

Abweichungen in Farbe, Kontrast oder Helligkeit zwischen Bildschirmdarstellung und Druck sind technisch bedingt und stellen keinen Mangel dar.

§4 Preise und Versandkosten

Alle Preise sind Endpreise.
Gemäß §19 UStG wird keine Umsatzsteuer ausgewiesen (Kleinunternehmerregelung).
Versandkosten werden im Bestellprozess gesondert angegeben.

§5 Lieferung

Die Lieferung erfolgt an die vom Kunden angegebene Adresse.
Lieferzeiten sind produktabhängig.
Individuell angefertigte Produkte (z. B. Sonderformate) können längere Produktionszeiten haben.

Bei Lieferungen in Länder außerhalb der Europäischen Union können zusätzliche Zölle, Steuern oder Gebühren anfallen. Diese sind nicht im Warenpreis oder den Versandkosten enthalten und sind vom Kunden bei der Einfuhr im Bestimmungsland zu tragen. Informationen hierzu erteilt die jeweils zuständige Zollbehörde des Empfängerlandes.

§6 Zahlung

Folgende Zahlungsarten stehen zur Verfügung (je nach Angebot):

Der Kaufpreis ist unmittelbar nach Vertragsschluss fällig.

§7 Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung Eigentum des Anbieters.

§8 Urheberrecht

Alle angebotenen Fotografien sind urheberrechtlich geschützt.

Mit dem Kauf eines Prints wird kein Nutzungsrecht am Bildmotiv übertragen. Der Erwerb berechtigt ausschließlich zum privaten Besitz.

Jegliche Vervielfältigung, Veröffentlichung, digitale Nutzung oder kommerzielle Verwendung ist ohne ausdrückliche schriftliche Zustimmung des Anbieters unzulässig.

§9 Gewährleistung

Es gelten die gesetzlichen Gewährleistungsrechte.

Kein Mangel liegt vor bei:

geringfügigen Farbabweichungen
materialtypischen Eigenschaften von Papier oder Druckverfahren

§10 Haftung

Der Anbieter haftet uneingeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit.

Bei einfacher Fahrlässigkeit haftet der Anbieter nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren, typischen Schaden.

§11 Streitbeilegung

Die EU-Kommission stellt eine Plattform zur Online-Streitbeilegung bereit:

Der Anbieter ist nicht verpflichtet und nicht bereit, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

§12 Schlussbestimmungen

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
